Terms of Service
Effective Date: March 11, 2026
Organization: The Long-Term Care Foundation, a Washington State nonprofit corporation (“we,” “us,” or “our”)
These Terms of Service (“Terms”) govern your access to and use of our websites, portals, applications, and services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and our Privacy Policy.
If you do not agree, please discontinue use of the Services.
1) Who We Are & What We Provide
The Long-Term Care Foundation is a nonprofit organization offering programs, resources, and support to the caregiving and long‑term care community in Washington State. Our Services may include:
- Educational materials and informational resources
- Training and certification support
- Event registration and volunteer opportunities
- Member or partner portals
We may update or discontinue Services at any time.
2) Eligibility
You may use the Services only if you:
- Are at least 18 years old
- Have authority to agree to these Terms
- Use the Services in compliance with applicable laws
If you create an account, you are responsible for maintaining accuracy of information and the security of your login credentials.
3) Acceptable Use
You agree that you will not:
- Violate laws or regulations
- Upload or transmit harmful code
- Harass or harm others
- Attempt to access systems without authorization
- Harvest data or scrape the site without permission
- Use the Services for unauthorized commercial purposes
We may suspend access for misuse.
4) Training, Programs & Certifications
We may facilitate access to training — including free or no‑cost training for eligible participants — often provided by third‑party training partners. Eligibility requirements, including Medicaid‑related criteria, may apply and may change at any time.
Completion, credentialing, and timelines are not guaranteed.
4A) Training Partner Responsibility & Liability
The Long-Term Care Foundation may partner with or provide access to third-party training providers, schools, instructors, or educational organizations (“Training Partners”). These Training Partners operate independently and are not employees, agents, or representatives of The Long-Term Care Foundation.
While we may provide information about available training opportunities or facilitate enrollment in programs, all training services are delivered and administered by the Training Partner.
The Long-Term Care Foundation:
- Does not control or supervise training providers, instructors, or curriculum
- Does not guarantee the quality, availability, scheduling, or outcomes of any training program
- Is not responsible for delays, cancellations, instructional content, or program changes
- Is not responsible for the actions, conduct, or policies of any Training Partner
All questions, concerns, disputes, or claims related to a training program — including instruction, scheduling, certification, attendance requirements, or completion — must be addressed directly with the Training Partner.
Participation in any training program is voluntary and at the participant’s own discretion. The Long-Term Care Foundation shall not be liable for any losses, damages, or disputes arising from participation in training programs provided by third parties.
Why this protects you
This clause protects your organization if:
- A school cancels a class
- A student fails an exam
- A school issues a certificate incorrectly
- A training provider provides poor instruction
- A student complains about the school or instructor
It makes clear that the school is responsible for the training, not your nonprofit.
5) Third‑Party Links & Services
Our Services may include links to or integrations with third‑party websites, training providers, or payment processors. We do not control or endorse these third parties and are not responsible for their content, policies, or actions.
5A) Caregiver & Adult Family Home Provider Relationships
The Long-Term Care Foundation may provide resources, referrals, training opportunities, or informational tools that connect caregivers and Adult Family Home (AFH) providers. However, we do not employ caregivers, operate Adult Family Homes, or act as an employment agency.
Any employment, contracting, or working relationship formed between a caregiver and an Adult Family Home provider is solely between those parties.
The Long-Term Care Foundation:
- Does not conduct background checks on caregivers or providers
- Does not verify licensing, qualifications, or employment eligibility
- Does not guarantee job placement or employment outcomes
- Is not responsible for hiring decisions, employment terms, workplace conditions, or performance of caregivers or providers
Adult Family Home providers are solely responsible for complying with all applicable state licensing requirements, hiring regulations, and background check requirements.
Caregivers are responsible for evaluating potential employment opportunities and determining whether a position is appropriate for them.
The Long-Term Care Foundation is not responsible or liable for any disputes, damages, losses, or outcomes arising from interactions or employment relationships between caregivers and providers.
This language protects you if:
- A caregiver harms a resident
- An AFH fires a caregiver
- A caregiver claims they were placed by your organization
- A provider claims a caregiver was referred by you
It makes clear you are a resource and education nonprofit — not an employer or placement agency.
6) Intellectual Property
Content on our Services is owned by The Long-Term Care Foundation or licensed to us. Except for personal or nonprofit educational use with attribution, you may not copy, reproduce, modify, or distribute our content without written permission.
7) Your Content
If you submit content (comments, materials, testimonials, etc.), you grant us a nonexclusive, royalty‑free, worldwide license to use it for the purposes of operating, improving, or promoting our Services and mission.
You represent that you have rights to any content you submit.
8) Privacy
Your use of the Services is governed by our Privacy Policy.
By using the Services, you consent to our data practices.
If you use third‑party services through our platforms, their privacy policies also apply.
9) No Professional Advice
Information provided through our Services is for educational purposes only and is not medical, legal, financial, or professional advice. Seek appropriate professionals for guidance specific to your situation.

11) Disclaimers
THE SERVICES ARE PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
We do not guarantee error‑free Service or accuracy of information.
12) Limitation of Liability
To the fullest extent allowed by law, The Long-Term Care Foundation and its directors, officers, employees, and volunteers will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Services.
Our total liability will not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.
13) Indemnification
You agree to indemnify and hold harmless The Long-Term Care Foundation and its representatives from any claims or damages arising from your use of the Services or violation of these Terms.

15) Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict‑of‑law principles.
You agree to the exclusive jurisdiction of the state and federal courts located in Washington State.
16) Changes to Terms
We may update these Terms at any time. Updates become effective upon posting unless otherwise stated.
Your continued use of the Services constitutes acceptance of revised Terms.
17) Termination
We may suspend or terminate access for any lawful reason, including violations of these Terms.
18) Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and The Long-Term Care Foundation regarding your use of the Services.
